A Federal High Court in Abuja has directed Nigeria’s electoral commission, INEC, to issue an access code to the Akin Rickett-led leadership of the All Democratic Alliance (ADA) for the party’s registration as a political party.
In a judgment delivered on Monday, Justice Peter Lifu gave INEC 72 hours to release the access code to the Protem Secretary of the ADA. The court also ordered the electoral body to open its portal for one week to allow the plaintiff’s team to upload required documents, including the membership register, as stipulated by law.
Justice Lifu ruled that INEC acted illegally by releasing the access code to Umar Ardo, who was not the recognized Protem Secretary of the association. The judge declared INEC’s action and all steps taken by Ardo on behalf of the ADA as “illegal, wrongful, null and void.”
The plaintiff, identified as the Protem National Chairman of the ADA, had sued INEC and Ardo, arguing that the electoral body breached extant laws by issuing the access code to the wrong person instead of the legitimate leadership.
Through his counsel, Stephen Atabo, the plaintiff sought several reliefs, including a declaration that information uploaded by Ardo was invalid and at variance with the association’s letter of intent. The court upheld the core claims, nullifying all actions taken by Ardo and directing INEC to deal exclusively with the Rickett-led faction.
The ruling effectively clears the way for the ADA to complete its registration process under the plaintiff’s leadership.
