Rochas Okorocha has filed a lawsuit against the Independent National Electoral Commission (INEC), the All Progressives Congress (APC) and Imo State Governor Hope Uzodimma, challenging the publication of Uzodimma’s name as the party’s candidate for the Imo West senatorial district in the 2027 general elections.
The originating summons, marked FHC/ABJ/CS/1854/2026, was filed on August 13 at the Federal High Court in Abuja by Okorocha’s lawyer, O.J. Aboje.
Okorocha, a former two-term governor of Imo State, is asking the court to determine whether INEC is bound by the reports of its officials who monitored the APC primaries held on May 18. He maintains that he emerged as the winner of that primary.
He further seeks a determination on whether, in light of Section 183 of the 1999 Constitution (as amended), INEC’s publication of Uzodimma’s name on August 1 as the APC candidate was wrongful.
Among the reliefs sought, Okorocha is requesting a declaration that it was unconstitutional for INEC to publish Uzodimma as the candidate when he did not win the primary. He wants the court to set aside the August 1 publication, direct INEC to recognise and publish his name as the duly nominated APC candidate, and restrain Uzodimma from parading himself as the party’s nominee. He is also asking for costs.
In a supporting affidavit deposed to by Amen Rochas, described as Okorocha’s son and personal assistant on political matters, it is stated that Okorocha is a registered, card-carrying member of the APC. The deponent noted that Uzodimma’s tenure as governor runs until midnight on January 14, 2028, after he was sworn in on January 15, 2024.
According to the affidavit, a direct primary was conducted by the APC on May 18, in which Okorocha scored 150,780 votes against Uzodimma’s 102,158. The results were to be forwarded to the party’s national secretariat for announcement, the deponent said.
The case is yet to be assigned a hearing date.
