The All Progressives Congress (APC) has filed a notice of appeal and a motion for stay of execution against a Federal High Court judgment that named another aspirant as its candidate for the Owo/Ose Federal Constituency.
In a letter dated August 6, 2026, and addressed to the Independent National Electoral Commission (INEC) Chairman, the party formally notified the commission of the legal steps taken. The letter, signed by A.G. Yirvoms Ayuba of Sozo Attorneys, stated that the APC expressed dissatisfaction with the August 5 ruling by Justice Peter O. Lifu, which declared Abdulghani Rotimi Arobo the party’s candidate.
The APC urged INEC to halt any enforcement of the court’s orders and maintain the status quo pending the resolution of the appeal. Copies of the notice of appeal and the motion for stay were attached, with the Ondo State Electoral Commissioner also informed.
A party source at the APC Secretariat confirmed that INEC continues to recognise Hon. Timehin Adelegbe as the candidate while the appeal is pending. “As things stand, Hon. Timehin Adelegbe remains the candidate recognised by the commission pending the final determination of the appeal,” the source said.
The party has also begun an internal review of the primary election results cited in the court proceedings. Those figures showed Arobo scoring 7,959 votes in Owo Local Government Area and 2,583 votes in Ose Local Government Area. Questions have been raised about the origin of the result sheets and whether they came from official party records.
Justice Lifu had ruled on August 5 that Arobo won the APC primary. The party maintains confidence that the Court of Appeal will address both the legal and factual issues in dispute.
