A Federal High Court in Abuja, presided over by Justice Inyang Edem Ekwo, has rejected an ex-parte application by Senator Samuel Anyanwu, the embattled National Secretary of the Peoples Democratic Party (PDP), seeking to stop the Independent National Electoral Commission (INEC) from recognizing his removal.
Rather than grant the request, Justice Ekwo ordered Anyanwu to notify INEC and other defendants in the suit, allowing them to present their positions in court.
Anyanwu had approached the court on Wednesday, urging it to restrain INEC or its agents from acknowledging any correspondence from the PDP that was not signed by him. His application, presented by his counsel, K.C.O. Njemanze (SAN), also sought to bar PDP Acting National Chairman, Ambassador Umar Illiya Damagun, from submitting any documents to INEC without his signature.
After reviewing the case, Justice Ekwo acknowledged the urgency but declined to grant the reliefs sought without hearing from the defendants. He directed Anyanwu to serve court documents on INEC and Damagun and scheduled the matter for hearing on February 24.
