Online publisher and African Action Congress presidential candidate Omoyele Sowore on Tuesday withdrew his application to compel the Director-General of the Department of State Services, Oluwatosin Ajayi, to appear as a witness in his ongoing criminal defamation case.
Appearing before the Federal High Court in Abuja, Sowore told Justice Muhammed Umar that the evidence he had sought from the DSS chief could instead be obtained from another official of the service. He therefore abandoned plans to force Ajayi’s appearance.
The development marked the first time Attorney-General of the Federation and Minister of Justice Lateef Fagbemi (SAN) personally led the prosecution team for the Federal Government.
Fagbemi opposed the subpoena, arguing that the DSS letter advising Sowore to delete social media posts in which he described President Bola Tinubu as a “criminal” was not authored by Ajayi. He said the document, already tendered and admitted in evidence twice, was written by another DSS official, Mr Uwen Davis, who had testified as a defence witness on July 22.
Counsel to Sowore, Olumide Fusika (SAN), challenged Fagbemi’s appearance, insisting that Akinlolu Kehinde (SAN) remained the counsel on record for the Federal Government.
Justice Umar adjourned the matter to Monday, August 3, for the continuation of Sowore’s defence.
