Donald Trump is facing a federal lawsuit over a new service that charges subscribers for early access to posts from his Truth Social account and those of several senior US officials.
The Intercept and the Freedom of the Press Foundation filed the lawsuit Wednesday in Manhattan federal court, seeking to block the White House from using Truth Social as an exclusive channel for official government announcements while the paid service, known as Truth API, remains in operation.
Launched on August 1 by Trump Media & Technology Group, Truth API charges subscribers as much as $100,000 a month for early access to posts from 10 prominent Truth Social accounts. The accounts include Trump, Vice President JD Vance, Health and Human Services Secretary Robert F. Kennedy Jr., FBI Director Kash Patel and the White House.
The plaintiffs argue that the arrangement violates the First Amendment by giving paying customers preferential access to presidential communications. They also contend that there is no legitimate government interest in allowing official announcements to be sold to private subscribers while Trump can financially benefit from the service.
Trump has frequently used Truth Social to announce policies and developments involving tariffs, foreign conflicts and other issues capable of moving financial markets.
The lawsuit comes days after Democratic Senators Elizabeth Warren and Adam Schiff urged the Securities and Exchange Commission to examine whether Truth API could undermine market integrity by giving wealthy investors and other subscribers faster access to potentially market-moving information.
Trump Media said the lawsuit was an attempt by what it described as “left-wing activists” to use the courts to target Trump and harm the company’s shareholders. The company also argued that numerous media outlets and platforms already distribute Trump’s posts through subscription-based services.
Trump Media interim Chief Executive Kevin McGurn said during an earnings call Monday that Truth API allows subscribers to receive information only “fractionally faster” than the broader public.
Trump remains Trump Media’s largest shareholder, holding a 41.3% stake worth about $950 million through his Donald J. Trump Revocable Trust, according to Reuters data. His eldest son, Donald Trump Jr., serves as a Trump Media director and oversees the trust.
The White House and other administration officials named as defendants had not immediately responded to requests for comment.
The lawsuit adds a new legal challenge to the administration’s use of Truth Social and raises broader questions about whether official presidential communications can be monetised while being used to inform the public.
