Aloy Ejimakor, lead counsel to Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), has dismissed claims that his client is avoiding trial.
Ejimakor stated that Kanu remains committed to facing trial but will challenge any court that fails to uphold the rule of law. He stressed that the IPOB leader would no longer tolerate institutional bias against him within the judicial system.
This position was made clear in a statement released after a routine legal visit to Kanu at the Department of State Services (DSS) detention facility in Abuja.
“During our visit today, Onyendu Mazi Nnamdi Kanu instructed us to inform the civilised world that he is ready for trial, provided it adheres to the principles of law,” Ejimakor stated. “He made it clear that the era of institutional bias against him in Abuja courts is over”.
Kanu believes that, with few exceptions, most decisions in his case have been unconstitutional, violating Section 36 of the Nigerian Constitution, which guarantees the independence and impartiality of the courts.
Ejimakor also referenced the Supreme Court’s finding that Justice Binta Nyako was biased in revoking Kanu’s bail, arguing that this should automatically disqualify her from presiding over the case. He criticized the Federal High Court Chief Judge, Justice John Tsoho, for reassigning the case to a judge whose jurisdiction had already been nullified by an order of recusal.
“For these reasons, the proceedings held on February 10, 2025, before Justice Binta Nyako have no legal basis,” Ejimakor asserted. “Any ruling made that day is equally void”.
He further dismissed claims that Kanu’s case has been adjourned indefinitely, clarifying that a judge who has been recused loses the authority to preside over the case.
“That is what the black-letter law states, and it shall stand, now and forever,” Ejimakor concluded.
