Two Senior Advocates of Nigeria (SAN), Olalekan Ojo and Kazeem Gbadamosi, have accused Justice Abdulrahman Oshodi of bias in the ongoing trial of former Central Bank of Nigeria (CBN) Governor, Godwin Ifeanyi Emefiele. They have formally requested that the judge recuse himself from further proceedings.
Justice Oshodi has scheduled a ruling for February 26 on the application seeking his recusal.
During Monday’s hearing, Emefiele’s lead counsel, Olalekan Ojo (SAN), argued that the judge’s comments during proceedings demonstrated prejudice. Ojo’s application for recusal was based on statements allegedly made by Justice Oshodi in open court, where he reportedly declared that the allegation of bribery against Emefiele had been proven.
The remark was made while prosecution counsel, Rotimi Oyedepo (SAN), was leading a witness, Adetola John, in evidence-in-chief. The defense team objected, arguing that such a statement, made before the conclusion of the case, especially before cross-examination of the witness indicated that the judge had already formed an opinion on Emefiele’s guilt.
“This court has granted an accelerated hearing on this matter, but what we are witnessing is an accelerated sentencing,” Ojo stated.
Kazeem Gbadamosi (SAN) also challenged Justice Oshodi’s continued involvement in the trial, insisting that his statement on the bribery allegation suggested a premeditated conviction. He urged the judge to step down to ensure a fair hearing.
Justice Oshodi is expected to deliver his ruling on the recusal application on February 26.
