Justice Salim Ibrahim of the Federal High Court in Abuja on Monday granted orders for substituted service of court processes on former Senate President Ahmad Lawan and Senator Ireti Kingibe over separate challenges to their emergence as candidates for the 2027 general elections.
The ruling came in two ex-parte motions filed by aggrieved aspirants contesting the validity of the primaries that produced the senators as flagbearers of their respective parties.
In the first suit, Hassan Kafayos is challenging Senator Lawan’s nomination as the All Progressives Congress (APC) candidate for the Yobe North Senatorial District. Lawan currently serves as Chairman of the Senate Committee on Defence.
Kafayos’ counsel, Francis Mgboh, informed the court that repeated attempts by the bailiff to serve the processes had failed, as the senator had proven evasive. The court granted the application, permitting service through any adult person found at the office of the Senate Committee on Defence.
The matter was adjourned to July 20 for hearing.
In the second suit, Mubarak Tijani is seeking the nullification of Senator Kingibe’s candidacy as the African Democratic Congress (ADC) candidate for the Federal Capital Territory (FCT) senatorial seat. Tijani’s lawyer, Moses Awuru, told the court that all efforts to serve Kingibe directly had been unsuccessful.
Justice Ibrahim approved substituted service through the senator’s legislative aide and adjourned the case to July 21 for further mention.
In the substantive suit, Tijani is praying the court to declare the purported result of the FCT Senatorial primary election that produced Kingibe as invalid.
