Abuja — A Federal High Court has ordered Nkemakolam Ukandu, National Welfare Secretary of the African Democratic Congress (ADC), to pay N50 million each to Chief Judge of the Federal High Court, Justice John Tsoho, and Justice Peter Lifu, as costs for a suit he filed but failed to diligently prosecute.
Justice Salim Ibrahim handed down the order on Monday following an oral application by James Igwe, SAN, counsel to the two judges. The total sum of N100 million is to be paid within 14 days.
The court had earlier struck out Ukandu’s suit, marked FHC/ABJ/CS/1165/2026, against the National Judicial Council (NJC), Justice Tsoho, and Justice Lifu for lack of diligent prosecution. Neither Ukandu nor his counsel appeared in court since the matter was assigned to Justice Ibrahim, despite a warning on June 30 that the suit risked dismissal.
Ukandu had dragged the defendants to court over alleged bias and disobedience of court orders. He sought an order compelling the NJC to investigate claims of corruption, abuse of judicial power, and bias against Justices Tsoho and Lifu.
The suit arose from the ongoing leadership crisis in the ADC, particularly the case of aggrieved member Nafiu-Bala Gombe, which is currently before Justice Lifu.
