A Federal High Court in Port Harcourt has dismissed a suit filed by the Rivers State Government, led by suspended Governor Siminalayi Fubara, alongside Victor Oko-Jumbo and two others, challenging the legitimacy of the suspended Speaker of the State House of Assembly, Martin Amaewhule, and 26 other lawmakers.
The plaintiffs approached the court to contest the positions of Amaewhule and the 26 legislators, citing their alleged defection from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC).
When the matter was called, counsel to the lead claimant sought an adjournment—a request that was strongly opposed by the defence team. Presiding Judge, Justice Emmanuel Obile, sided with the respondents and proceeded with the case.
In his judgment, Justice Obile ruled that the court lacked jurisdiction, noting that the subject matter had already been resolved by the Supreme Court in a related case. He subsequently dismissed the suit.
This is not the first time Justice Obile has ruled on the matter. In a similar case filed by the Labour Party against the same set of lawmakers, he also dismissed the suit, citing the same jurisdictional grounds and deference to the Supreme Court’s earlier decision.
