The Delta State High Court on Tuesday refused bail to Ifeanyi Ogbonna, popularly known as Odogwu Asaba, who is facing allegations linked to the death of Favour Agbro.
The court ordered that Ogbonna remain in custody at the Ogwashi-Uku Maximum Correctional Centre. It also directed the Director of Public Prosecutions to file the formal Information against him within 14 days.
The ruling followed arguments on the bail application. According to a statement from the defendant’s lawyers, Triple O and C Chambers, the court declined the request at this stage, citing concerns over the applicant’s safety and possible public reaction while the Information had not yet been filed. The judge held that Ogbonna would be free to renew his bail application once the charges are formally preferred.
Ugochukwu Okoli, N.N. Onuzurike and C.S. Chukwudolue appeared for Ogbonna. Dr R.O. Ishiguzo, a law officer with the Nigeria Police Force State CID in Asaba, represented the Commissioner of Police.
Awele Ideal, counsel representing Favour’s family on a pro bono basis, confirmed the outcome. She said the bail application was argued and the court ruled against granting it. Ideal restated her commitment to continue representing the family.
Comrade Deo, a human rights advocate involved in the campaign for justice for Favour, described the decision as “a reminder that justice is a process.” He praised Ideal’s work and opposed the bail application. Deo also alleged that activists had monitored Ogbonna’s movements and cooperated with police in the efforts that led to his arrest in Asaba. He stressed that the refusal of bail does not amount to a conviction and that the allegations remain unproven until determined by the court.
Ogbonna is presumed innocent unless and until proven guilty. The case now moves to the filing of the Information by the DPP, after which a fresh bail application may be made.
