A High Court of the Federal Capital Territory in Abuja has ordered the Nigeria Police Force to pay N12 million in damages to Kasarahchi Aniagolu, a reporter with The Whistler newspaper, over her abduction and unlawful detention.
Justice Bello Kawu delivered the judgment in a fundamental rights enforcement suit filed by Aniagolu against the Inspector-General of Police and the Nigeria Police Force. The journalist was arrested, assaulted and held for eight hours on 21 February 2024 in Wuse Zone 4, Abuja, during a police operation targeting illegal bureau de change operators.
Aniagolu, represented by Adekunle Kosoko of Seasons Law Firm, sued in October 2024 seeking N100 million. She told the court that officers seized her phone, deleted photographs, and subjected her to inhuman treatment while she was held at a police station in Guzape District.
In his ruling, Justice Kawu held that the police subjected the applicant to inhuman and degrading treatment in breach of Section 34(1)(a) and (b) of the 1999 Constitution (as amended). The court also declared that her abduction and subsequent detention violated her right to personal liberty under Section 35(1) of the Constitution.
The judge awarded N10 million as damages for the rights violations and a further N2 million as costs of the action.
