An Abuja High Court has scheduled July 9, 2025, for the hearing of a suit filed by former federal lawmaker, Farah Dagogo, challenging President Bola Tinubu and others over the declaration of emergency rule in Rivers State.
Dagogo is contesting the legality of the suspension of Governor Siminalayi Fubara, his deputy, Professor Ngozi Nma Odu, and members of the Rivers State House of Assembly. He argues that the President acted outside his constitutional powers by attempting to impose an administrator in a state with a democratically elected government.
At the resumed sitting, Justice James Omotosho granted an adjournment following a request by the counsels to the first and fifth defendants — Professor Kanyinsola Ajayi, SAN, and Abduljabar Aliyu — who sought more time to respond to the plaintiff’s submissions. The plaintiff’s counsel, Babafemi Adegbite, did not oppose the application.
Originally filed at the Port Harcourt Division of the Federal High Court, the case was later transferred to Abuja following a directive from the Attorney-General of the Federation to the Chief Judge of the Federal High Court.
Dagogo insists that the President has no constitutional authority to suspend an elected state government or replace it with a federal appointee, and is asking the court to declare such actions illegal.
