The All Progressives Congress (APC) in Kano State has indicated the possibility of challenging the recent ruling of the Court of Appeal at the Supreme Court, pending consultations with its legal team.
Earlier on Thursday, the Court of Appeal in Abuja overturned a ruling by the Federal High Court in Kano, which had barred the Kano State Independent Electoral Commission (KANSIEC) from conducting local government elections. The appellate court ruled that the lower court acted beyond its jurisdiction.
Reacting to the development, APC spokesperson in Kano, Ahmad Aruwan, said the party would carefully review the judgment with its legal advisors before deciding on the next line of action.
“Whenever a judgment is delivered, our legal team thoroughly studies it, and then the party collectively decides whether to proceed with an appeal,” Aruwan stated.
He also referenced a similar legal case in Rivers State, where the Supreme Court upheld the jurisdiction of a Federal High Court in an electoral dispute, suggesting that precedent could play a role in their deliberations.
“The Court of Appeal ruled that the Federal High Court lacked jurisdiction, but importantly, our claims were not struck out,” Aruwan said. “Our key contention remains that KANSIEC lacks the legitimacy to oversee the elections, as its leadership consists of card-carrying members of the New Nigeria People’s Party (NNPP).”
The APC had challenged the credibility of KANSIEC, alleging partisanship in its composition.
