A Federal High Court in Lagos has nullified a House of Representatives resolution directing Seplat Energy Producing Nigeria Unlimited to pay N72.624 billion in compensation to communities over alleged oil spill incidents.
Justice Allagoa delivered the judgment in Suit No. FHC/LAG/CS/862/2026, ruling that the National Assembly exceeded its constitutional powers by determining civil liability and awarding damages. The court declared the resolution unconstitutional, null and void.
Seplat had challenged a November 14, 2025, House report that found the company liable for oil spill-related claims and ordered payment of the sum. A letter from the Clerk to the National Assembly conveyed the resolutions, which also directed instalment payments and summoned the company’s managing director and chief executive officer before several committees.
Through its lawyers, Seplat argued that the House of Representatives unlawfully assumed judicial functions by adjudicating alleged civil wrongs and compelling payment of compensation. Counsel maintained that such powers rest exclusively with courts of competent jurisdiction and that the House Committee on Public Petitions lacked authority to make these determinations.No legal representation appeared for the House of Representatives.
In its ruling, the court upheld all of Seplat’s reliefs. It held that while the National Assembly has investigative powers under the Constitution, those powers do not extend to deciding liability in civil disputes or awarding monetary compensation. By directing payment of N72.624 billion as damages, the House exercised judicial powers reserved for the courts.
Justice Allagoa interpreted Sections 4(1), 6(6)(b), 88(2) and 251(1)(n) of the 1999 Constitution (as amended) and concluded that the House acted ultra vires its mandate. The judge stated that legislative investigative authority cannot serve as a substitute for judicial proceedings or as a basis for imposing civil liability on individuals or companies.
