The Supreme Court has dismissed the appeal filed by the Peoples Democratic Party (PDP) and its governorship candidate, Agboola Ajayi, seeking to nullify the candidacy of Ondo State Governor, Lucky Orimisan Aiyedatiwa, in the upcoming November 16, 2024, election.
Delivering judgment on Tuesday, Justice Garba Lawal ruled that the appeal was baseless, frivolous, and lacked merit. The apex court upheld the decisions of both the Federal High Court and the Court of Appeal, which had earlier dismissed Ajayi’s challenge on procedural grounds.
Ajayi had contested Aiyedatiwa’s eligibility on the grounds that his deputy, Olayide Owolabi Adelami, allegedly engaged in forgery, impersonation, and the use of a false identity. However, the lower courts ruled that the allegations required substantial evidence beyond an originating summons.
The case, originally filed on June 7, 2024, was dismissed by the Federal High Court on December 2, 2024, citing a lack of legal standing and the expiration of the 14-day constitutional window for pre-election disputes. The Court of Appeal upheld this decision on January 18, 2025, imposing a ₦500,000 fine on Ajayi.
With the Supreme Court’s latest ruling, the long-running legal battle over the Ondo State governorship election has officially come to an end.
